Stokke AS and the Tripp Trapp® chair succeeded in dispute against copyist in the Court of Appeal
15. September 11
Trumf AS offered a children's chair called "Oliver" to it's members in a customer loyalty program. Stokke AS claimed that the chair was a copy of it's well-known Tripp Trapp chair, and that their copyright and trademark rights related to this product were infringed.
The court found that the Tripp Trapp chair is a work of art that fulfills the
conditions for copyright protection. According to the court, the Oliver chair
was a very close imitation of the Tripp Trapp chair.
Furthermore, the court found that Trumf AS' use of the slogan "This great chair
grows with your child" was an infringement of Stokke AS' trademark "The chair
that grows with your child" (our English translation of the respective Norwegian
slogans).
Stokke AS was awarded NOK 450.000 in compensation for damages related to infringement
of their copyright and trademark rights.

New EU patent and Court
The EU parliament has passed the establishment of a unitary EU patent, and a court for enforcement thereof. Thus, one will be able to apply for an EU patent and enforce it in the whole of Europe through a single, common judiciary system, without the need for acting through the national courts in each member state. As an EPC member but not EU member Norway is excluded, so EPC applications will still be validated in Norway, and enforced through national Norwegian patent court cases.
